"Lost" is once again playing fast and loose with the US legal system -- like when Kate was tried in L.A. County court for a federal crime (bank robbery) and a murder that took place in another state! He's trying to rally the forces to return to the island, so the natural thing for him to do would be to spook Kate. He knows that she will run, and there really isn't anyone else that she can run to except Jack. Which is right where Ben would want her, so that's my hypothesis. I thought that Jack could possibly be in league with Ben on the scheme, being in the best legal position to petition the court for a blood test, but I doubt that he would do that to her, and it would also directly contradict their whole O6 story so I'm betting on Ben.
